By reading this notice, you agree to be bound by the following terms and conditions. Please read them carefully. Your usage of this notice indicates your acceptance and understanding of these terms. If you purchase an item from Upmega Furniture (UPM), it signifies your acceptance of these terms.
1. DISCLAIMER FOR PRODUCTS SOLD
Except as expressly stated herein, Upmega Furniture (UPM) makes no representations or warranties, either express or implied, of any kind with respect to products sold. In no event shall Upmega Furniture (UPM), its directors, employees, or representatives be liable for direct, indirect, consequential, or punitive damages related to the products sold.
2. DELIVERY POLICY
2.1 General Terms
We are not liable for delays or failures due to circumstances beyond our control.
You must inform us of any changes to delivery instructions.
A signed acknowledgment confirms goods were received in good condition.
2.2 Unattended Deliveries
If you request unattended delivery, UPM is not responsible for subsequent loss, damage, or theft.
2.3 Postponements & Special Requirements
Notify the showroom at least 2 days in advance to reschedule.
Inform staff of special requirements (e.g., narrow entrances) at purchase. Deliveries beyond the entrance are at your risk.
For orders that have already started production, you cannot change the fabric type, colour, or type of sofa.
2.4 Delivery Timelines & Fees
Nairobi & Environs: Charged at KES 200 per seat (traffic dependent).
Outside Nairobi: Third-party transport at additional cost.
Extra charges apply for stairs, non-ground-level access, or late (<24 hours) changes. Pay directly to the driver.
3. PAYMENT METHODS
3.1 Accepted Methods
M-Pesa PayBill Only (no cash payments accepted). Full payment is required before and after delivery, as per agreement.
We reserve 10% of the total payment as a deposit to secure your order.
3.2 Address Verification
If billing/delivery addresses differ, provide proof of address.
4. REFUNDS & RETURNS
4.1 Faulty Items
Report within 24 hours for inspection. Replacement or credit voucher issued if unfixable. Excludes misuse/accidental damage.
4.3 Cancellations
Notify the store ≥3 working days before delivery.
10% deposit deduction; delivery fees non-refundable if attempted.
4.4 Refund Eligibility
Refunds/exchanges only for:
Faulty/non-replaceable items.
Wrongly described or non-matching samples.
5. WARRANTY POLICY
Our company offers a 1-year warranty on the following components:
Seat functionality
Framework
Reclining system
Fabric
Warranty Terms:
The warranty applies to defects in materials or workmanship under normal use.
Misuse, accidental damage, or unauthorized repairs void the warranty.
Warranty claims must be reported within 30 days of discovering the defect.
Proof of purchase is required for warranty service.
6. CUSTOMER DETAILS
Provide accurate delivery addresses and phone numbers. Note sales staff name and order date for reference.
7. OTHER POLICIES
Stock: Subject to availability.
Accessories: Not included unless specified.
Pricing: No further discounts on sale/clearance items.
